2. Estimates, Scheduling Requests, and Online Submissions

Any request submitted through the Site (including contact forms, appointment requests, membership inquiries, or “request an estimate” submissions) is a request for Company to contact you. Submitting a request does not guarantee availability, scheduling, pricing, or acceptance of any job.

Only a signed/approved estimate, work order, invoice, or written agreement issued by Company governs the scope of work, pricing, and service terms.

3. E-Signatures and Electronic Records

If you approve estimates, invoices, service plan enrollments, or other documents electronically, you agree that electronic signatures and records are valid and enforceable to the fullest extent permitted by law.

4. Promotions and Pricing Disclosures

Promotions, discounts, and advertised pricing are subject to change and may be limited by time, geography, eligibility, equipment type, or other terms disclosed at the time of offer. Unless explicitly stated otherwise in writing, promotions do not apply retroactively and cannot be combined.

If the Site references Comfort Club promotional pricing, you acknowledge that renewals occur at the then-standard rate disclosed in the applicable plan agreement or at the rate disclosed at renewal.

5. Payments and Refunds (If Applicable)

If the Site allows you to make payments or place deposits, all payments are processed using third-party payment providers. Company does not store full payment card details on the Site. Payment obligations, refunds (if any), and payment timing are governed by your approved quote/invoice and the applicable service agreement.

6. Maintenance Plan Enrollment Through the Site

If the Site offers enrollment or lead capture for Company’s maintenance plan, enrollment is governed by the applicable Service Plan Agreement. The Service Plan Agreement controls in the event of any conflict with these Website Terms.

7. Intellectual Property

The Site and its content (including text, graphics, logos, photos, videos, and design) are owned by Company or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from the Site content without Company’s written permission.

8. Acceptable Use

You agree not to:

Use the Site for unlawful purposes
Attempt to gain unauthorized access to Site systems
Interfere with the Site’s security, availability, or performance
Submit false, misleading, or fraudulent information
Use automated tools (bots, scrapers) to access the Site without written permission

Company’s total liability for any claim arising out of or relating to the Site is limited to the amount you paid to Company through the Site in the twelve (12) months preceding the event giving rise to the claim, or $100 if you paid nothing.
